    i think it depends on two things, one of which was already hit upon here. if youre drawing something directly from a photo and not really changing anything at all, or changing it very little, then its technically illegal. the Shepard Fairey "Hope" poster that was mentioned already is an example. he pretty much reprinted a photo and added a border and some lettering.
